In brief: These terms apply to the BVTechLabs public website. Development work is governed only by an agreed Statement of Work and the terms incorporated into it.
1. Acceptance and scope
By accessing or using bvtechlabs.co.za (the "website"), you agree to these Website Terms of Use. If you do not agree, please do not use the website.
These terms govern website access only. They do not, by themselves, appoint BVTechLabs to perform services or create a client relationship.
2. Development and consulting services
BVTechLabs (Pty) Ltd ("BVTechLabs") provides software delivery, mobile and web development, automation, cloud solutions and technical consulting. Descriptions, examples, estimates and other website content are general information and are not binding offers, guarantees or project commitments.
A services engagement begins only when BVTechLabs and the client agree a quotation, proposal, order form or Statement of Work. Our Standard Development Terms apply only when that project document incorporates them.
3. Permitted use
You may browse and use the website for lawful informational and business-enquiry purposes. You may not:
- attempt to gain unauthorised access to the website, infrastructure or connected systems;
- introduce malicious code, interfere with availability or bypass security controls;
- use automated extraction in a way that burdens the website or infringes rights;
- impersonate another person, submit misleading information or use the website unlawfully; or
- copy or commercially exploit protected content without written permission.
4. Intellectual property
Unless stated otherwise, website text, graphics, branding, logos, layouts and software are owned by or licensed to BVTechLabs and are protected by applicable intellectual-property laws. No rights are transferred merely because the website is publicly accessible.
Third-party names, products and marks remain the property of their respective owners.
5. Accuracy and reliance
We take reasonable care when publishing information, but website content may be incomplete, become outdated or contain errors. You should obtain project-specific written advice before relying on it for a technical, commercial, legal or operational decision.
6. Availability and security
We may change, suspend or discontinue any part of the website. We do not promise that it will always be available, uninterrupted, secure or free from errors or harmful components. You remain responsible for appropriate device, browser and security protections.
7. External links
Links to third-party websites are provided for context or convenience. BVTechLabs does not control or endorse those services and is not responsible for their content, availability, security, privacy practices or terms.
8. Privacy
Our Privacy Policy explains how BVTechLabs handles personal information received through the website, business communications and project engagements.

9. Disclaimers and liability
To the maximum extent permitted by law, the website and its content are provided "as is" and "as available", without implied warranties.
BVTechLabs is not liable for indirect or consequential loss, loss of profit, revenue, business opportunity, goodwill or data arising from website access, inability to access the website, reliance on general website content, or use of a linked third-party service.
Nothing in these terms excludes or limits liability, rights or remedies that applicable law does not allow to be excluded or limited.
10. Consumer protection
If the Consumer Protection Act 68 of 2008 or another mandatory law applies to you, these terms must be interpreted consistently with that law. No provision is intended to waive a right or exclude an obligation where doing so is prohibited.
11. Changes to these terms
We may update these terms by publishing a revised version and changing the date above. The version available when you use the website applies to that use. A website update does not retrospectively change a signed project agreement.
12. Governing law
These terms are governed by the laws of the Republic of South Africa. Subject to any mandatory statutory forum or remedy, disputes are subject to the jurisdiction of the South African courts.
